Welsh Government Amends Proposed Ban on E-Cigs in Public

Some good news for e-cigarette smokers has come to light thanks to a U-turn from the Welsh Government.

The Government previously planned to ban people from using e-cigs in every public place. However, this has now been watered down and the proposals are now only likely to include places where there could be a “potential risk to children”. This could well mean restaurants and other similar outlets will have to ban vapers. Public transport is also likely to be affected by the new ban.

A statement issued by The Association of Licensed Multiple Retailers argued that each licensee should be allowed to make their own decision on whether to ban e-cigs or not. The statement pointed to “heavy-handed legislation” and the possibility that such a ban could “seriously disrupt trade”.

No doubt vapers will have something to say about this. News that a blanket ban will now be ditched will come as a relief to many. However, since evidence indicates that vaping is far safer than smoking, some will be disappointed that a ban on vaping in pubs, clubs and eateries still looks set to be brought in.

No one wants children to come to harm, but it seems as though governments are perhaps being a little too quick to bring in laws against e-cigarettes without having done their research first. While no dates or further details were given concerning the changes, it still seems unlikely the Welsh government would completely back down on the ban. Only time will tell.

In the meantime, it looks as though vapers are gradually finding they have fewer and fewer places to vape. While some pubs and other public places have enacted their own bans on vaping, these bans do not apply to everyone. Not yet, anyway.

Could it be Illegal to Vape While Working from Home?

It sounds unlikely and somewhat bizarre, doesn’t it? And yet this could be true if the Welsh Government has its way.

No doubt you are familiar with the current ban on smoking. You’re probably also familiar with the fact vaping is also now being banned in some locations. These include trains and railway stations across the country, not to mention some pubs and other locations.

Yet the idea of banning vaping at home – well, that’s just bizarre, surely?

The idea is easy enough to understand. The Welsh Government wants to make sure vaping is banned in all workplaces by the time 2016 comes to an end. There is some controversy over this idea alone, since vaping is clearly not on the same level as smoking, in terms of the risk of passive smoking. However, more and more establishments are looking to ban vaping in public and in enclosed spaces.

How would it work?

Whatever you might think of that, let’s consider how this law would work if you were working at home. Let’s say you have a home office and you work between the hours of, say, 10am and 5pm every day. Now, at the moment, you can vape to your heart’s content whenever you’re at home. Yet if this new law does come into force, you will no longer be allowed to vape when you are working.

That literally means you can vape at home outside of working hours, but between the hours of 10am and 5pm you would literally be breaking the law by vaping in your own home. And more than that, you could technically be breaking the law if you were going through work emails at home while vaping.

According to recent reports, a Conservative spokesperson said the measures were “unenforceable”. We would have to agree on that point. After all, how is anyone going to know when you were vaping and whether you were working or not? The only way it could work would be if someone called you at work and you happened to make some comment about vaping at the time. They could report you, you could be hauled into court… yes, it does sound crazy, doesn’t it?

And yet this is surely the only conceivable way anyone would ever be prosecuted under these proposed new measures. It is one thing to lay out a series of measures that are quite clear on when you can and cannot vape in your home while working there. But it is quite another to work out how such a rule could ever be enforced.

Surely then this is a giant waste of time, when there are other far more important things to be focused on? We expect work-at-home vapers to be amazed and incredulous over this new proposed measure. It remains to be seen whether the legislation will come into play, but it looks as though the Welsh Government wants vaping to come into line with smoking – and as soon as possible.

We have written a consensus country by country on vaping. We simplified it into three categories banned, permitted and unclear (which includes partial).

Electronic cigarettes, e-cigarettes, e-cigs and vaping are products sold as a smoking substitute. They don’t fall into the category of tobacco products or pharmaceutical products or even as a cessation product. Currently uncategorised they can be described as a product intended to deliver nicotine and or with flavour which can also be used as an alternative to smoking tobacco.
Pharmaceutical licenses are MA (Market Authorisation) to sell a product as a licensed medicinal product and to date no e-cigarette has such a license.

In some cases countries ban the commercial import but not the personal import of e-cigarettes and hence deliveries through the mail system are not affected.

E-Cigarettes and nicotine liquid are considered to be consumer goods regulated by general product safety regulations, unless they meet the criteria for medical licensing: if they claim to be for smoking cessation; or if the amount of nicotine in the cartridge is greater than or equal to 10 mg; or if the nicotine strength in a refill is more than or equal to 20mg/ml.

FINLAND – Partial permission. Nicotine-free liquids and e-cigarette devices can both be sold in Finland.
GREECE – Unclear.
HONG KONG – Partial permission. E-cigarettes containing nicotine are classified as licensable poison products and prohibited.
IRAN – Unclear.
JAPAN – Partial permission. E-cigarettes with nicotine are banned because they are classed as unlicensed medical products.
MAURITIUS – Unclear.
NEW ZEALAND – Partial permission. Zero-nicotine products are permitted.
NORWAY – Partial Ban. The Norwegian Tobacco Act forbids the sale of new tobacco products and/or nicotine products, a classification that they claim encompasses ecig products. Imports from EU countries are generally accepted.
SOUTH AFRICA – Unclear.
SWEDEN – Partial permission. E-cigarettes and nicotine-free cartridges may be sold, but nicotine-containing refills are prohibited.
